Your Right to Emergency Medical Care
It’s Not Just Policy—It’s Federal Law
If you are experiencing a medical emergency or are in active labor, you have the legal right to receive the following services—regardless of your ability to pay or insurance status:
- A prompt and appropriate Medical Screening Examination to determine if an emergency medical condition exists.
- Necessary Stabilizing Treatment, including care for an unborn child, if applicable.
- If needed, an appropriate and timely transfer to another medical facility with the capacity to provide the required treatment.
These rights are protected under the Emergency Medical Treatment and Labor Act (EMTALA) and apply to all patients—even if you are uninsured, cannot pay, or are not enrolled in Medicare or Medicaid.
